TERMS & CONDITIONS

 

Introduction

Unless otherwise agreed, these Terms and Conditions shall apply to all contractual relationships between Kratos Medical and its Clients.

Definitions:

 

“Doctor or Healthcare Professional” means a medical professional who has practising privileges at Kratos Medical and which includes medical practitioners, doctors, physiotherapists, specialists and other such practitioners who treat the Client.

“Client” clients or patients who are paying Kratos Medical for their own treatment regardless of whether they are entitled to have NHS treatment or care.

“Applicable Law” means any and all laws, regulations, guidelines and professional obligations applicable to the provision of Care or the performance of services for the Client, including the requirements as regards treatment.

“Care” means care, treatment, diagnosis, services (including sundry items) and any goods provided by Kratos Medical, which include any aftercare items.

“Contract” means these Terms, Client Onboarding and, if applicable, your after care information brochure/guides.

“Price” means how much you as the Client will pay for your Care, as set out in our treatment brochure or website.

“Terms” means these terms and conditions.

Scope of Care


The scope of the Care covers the medical practice and service provided by the Doctor to the Client under their own professional knowledge and qualified experience.

We endeavour to provide a satisfactory standard of Care, facilities and resources for the Care.  However, Kratos Medical reserves the right to refuse any consultation, diagnostic procedure or therapy/treatment, including, but not limited to, the result of an event outside the control of the Kratos Medical, for operational or technical reasons or because the Doctor does not think it is in the Client’s best interests to proceed with the Care or treatment for medical reasons.

Medical conditions and treatments should be conducted during face-to-face consultation. Any information or advice provided by alternate means shall not constitute medical advice and should not be substituted for regular consultation with the Client’s Doctor or Healthcare Professional. If the Client has any concerns about their health, they should contact their Doctor or Healthcare Professional immediately.

Cancellations:

We reserve the right to charge a cancellation fee if a Client cancels any appointment with Kratos Medical within 24 hours of a scheduled appointment. A cancellation fee may be based on any Care that a Client has received up to the point of cancellation and/or any other reasonable costs that Kratos Medical has incurred.

The Client is responsible for settling the cost of their Care immediately following their consultation or treatment.  Kratos Medical may ask you for your credit or debit card details when the Client makes an appointment. Kratos Medical will keep these details for up to six months after the last date of the Client’s Care or other appointment with your Kratos Medical. If not paid within 7 days of your consultation or treatment, the Client agrees that Kratos Medical can debit the full outstanding balance together with any cancellation fees from the Client’s credit or debit card upon 7 day’s of notice to the Client.

Data Protection / Confidentiality

Kratos Medical is committed to the fundamental right of protecting data. Kratos Medical will process its Client’s data in compliance with the General Data Protection Regulation and Data Protection Act 2018.

Kratos Medical is committed to protect the Client’s confidentiality in accordance with the relevant legislations including The Data Protection Act (DPA) 1998, the Health and Social Care Act 2012, the Health and Social Care (Safety and Quality) Act 2015, the Medical Reports Act 1988 and Health Records Act 1990 and the guidelines on confidentiality issued by the British Medical Association.

Any information provided to Kratos Medical will be used only for the purpose given by the Client. Kratos Medical will not pass this information onto any other party without the express permission of the Client.

Doctors or Healthcare Professionals may use the email addresses and contact numbers as provided by the Client for communication purposes.

Internet email is not a secure medium. Emails sent via the Internet could be intercepted and read by someone else. The client has responsibility to ensure laws are not broken when composing or forwarding emails and their contents.

Access to deceased patients’ health records is governed by the Access to Health Records Act 1990 whereby a personal representative (i.e. the executor or administrator of the deceased person’s estate) or someone who has a claim resulting from the death (this could be a relative or another person) may access the data.

 

Intellectual property rights

 

Kratos Medical is the owner of all intellectual property rights for Kratos Medical, and in the material published by it, website, brochure or online content. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. The Client may print off one copy, and may download extracts, of any page(s) from our website for personal use only.


The Client must not modify the paper or digital copies of any materials the Client has printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Kratos Medical’s status (and that of any identified contributors) as the authors of content on the Kratos Medical Website must always be acknowledged. The Client must not use any part of the content on the Kratos Medical website for commercial purposes without obtaining a licence to do so from Kratos Medical.


If the Client prints off, copies or download any part of the Kratos Medical website in breach of these Terms, their right to use the Kratos Medical website will cease immediately and the Client must, at Kratos Medical’s option, return or destroy any copies of the materials they have made.

Medical information


Kratos Medical provides Care, medical services and information.  Services, information and/or Care, that Kratos Medical provides may not meet the Client’s health or medical requirements. The Client must contact an alternative health professional or seek alternative medical treatment if advised to do so by any member of the Kratos Medical team.


If Kratos Medical provides the Client with any given advice outside of any consultation, this does not constitute medical advice in relation to any individual case or Client.  This is intended to assist the Clients in the patient journey towards to the most appropriate site of care for them.

The contents of the Kratos Medical website and online video/blogs should not be considered medical advice and if a Client is concerned about their healthcare with regard to this online content, they should seek information from a suitably qualified Doctor or Healthcare Professional.

Fees
The fee for the Care provided by Kratos Medical to the Client is subject to the statutory provisions.
The fee becomes due and payable immediately after consultation or treatment or presentation of a final invoice. After expiration of thirty days (30) days from
presentation of the account Kratos Medical has the right to charge interest on such overdue account at the rate of one (1) percent (%) above the prime lending rate applicable.
In the event where the Client has failed to pay the fee mentioned above, Kratos Medical has the right to recover any legal costs to recover the amount due, including its legal costs and Client costs levied including collection commission and all related legal costs incurred.

Insured Patients

Kratos Medical does not at this time, accept private insurance.  All clients are individually responsible for their fees.

 

Contractual Information

The Client’s contract is with Kratos Medical: By attending to an appointment, and/or completing the Client onboarding documentation and/or completing third party therapy documentation (for example IntraVita registration form), the Client agrees to be bound by these Terms.

Kratos Medical may update these Terms from time to time however any changes will only apply to any new episode of Care that the Client receives.

Note that any new Terms will not apply to any Care which is part-way through when the Terms are changed.

Notices and contact details: It is important that the Client keep Kratos Medical updated of any changes in their contact details.

Kratos Medical does not accept any responsibility for the theft or loss of, or damage to, any of the Client’s property.

Changes in Applicable Law: You acknowledge and accept that Applicable Law may change and prevent Kratos Medical from providing certain Care. Kratos Medical will endeavour to contact you if a change has occurred and the change has an effect on your Care, and subsequent consequences thereof.

Third Party Rights: Except for you or Kratos Medical, no person will have any rights under or in connection with these Terms.

For health and safety reasons, if needing to visit Kratos Medical offices the Client must comply with all safety advice given by any third-party staff members, signs and warnings, remain in reception and consultation areas and avoid restricted and/or staff only areas.

Kratos Medical has obtained insurance cover in respect of Kratos Medical’s own liability for individual claims. If the Client is a professional sports person and/or a public figure they may need more cover, it will be the Client’s own responsibility to make their own arrangements for the appropriate insurance of any excess loss. If the Client has concerns in this regard, they should discuss this with their Doctor or Healthcare Professional.
Kratos Medical ensures that all Doctors are fully licenced by the General Medical Council and Kratos Medical is fully registered with Health Inspectorate Wales.

Force Majeure
Kratos Medical will not be liable or responsible for any failure or delay in performance of any of its obligations under these Terms which are caused outside the reasonable control of Kratos Medical.

Complaints Procedure
The Client has the right to make a complaint to Kratos Medical by email on
[email protected] The responsible Doctor or Healthcare Professional will review and be in contact no later than 30 business days of filing a complaint. Kratos Medical is registered with Health Inspectorate Wales and all complaints that are not suitably resolved, may be escalated to Health Inspectorate Wales, if required.

Changes in Applicable Law
The Client acknowledges and accepts that applicable laws, regulations, guidelines and professional obligations applicable to the provision of Care and/or services, may change and prevent Kratos Medical from providing you with certain Care. If the Kratos Medical becomes aware that such a change has occurred and has an effect on your Care,
Kratos Medical will endeavour to contact the Client to inform them of its consequences.

Jurisdiction and Law
These Terms and any health services provided by the Kratos Medical to the Client shall be governed by and construed in accordance with the laws of the England and Wales and the courts of England and Wales shall have non-exclusive jurisdiction.

Disclaimer
Whilst Kratos Medical will take all reasonable care to ensure the safety of the Client’s belongings Kratos Medical is not be liable or responsible for any loss of, damage or destruction to, any property, including money and valuables, belonging to the Client, or in possession of the Client, or given to Kratos Medical for safekeeping, even if Kratos Medical is/was negligent in any way and no matter how any loss, damage or destruction was caused.
